By Caroline Simson (March 22, 2022, 7:04 p.m. EDT) — A controversial linguistic methodology may be about to have a moment now that it’s caught up in a pending case before the United States Supreme Court, which asks judges to determine whether federal courts can order discovery for a foreign private commercial arbitration.

The Supreme Court is due to hear arguments in the case involving a U.S. unit of German auto parts maker ZF Group on Wednesday, and the methodology, called corpus linguistics, is expected to be up for debate. Corpus linguistics involves analyzing large sets of texts to discover linguistic patterns of usage.
